01. About these terms
These terms explain the general conditions under which DigiMade provides website design, branding, graphic design, print management, printing and related services. They should be read alongside the written quotation, proposal or order confirmation for your project. If an agreed written proposal conflicts with these general terms, the agreed project-specific terms take priority to the extent of that conflict.
These terms are issued by DIGIMADE LTD (trading as DigiMade), registered in England and Wales under company number 17531328, with its registered office at Ashley House, Main Street, Walesby, Newark, NG22 9NU. Contact: info@digimade.co.uk.
02. Quotes and placing an order
Prices and specifications are confirmed in writing before work begins. Quotes are valid for the period shown on the quotation; where no period is stated, please request reconfirmation before accepting, as third-party printing and hosting costs can change.
An order is accepted when DigiMade confirms it in writing. A quotation is not a guarantee of availability or a binding order until acceptance. Please tell us before ordering if you are purchasing as a consumer rather than for business purposes, because different statutory rights may apply.
03. Payments and project milestones
Any deposit, stage payment, final balance and due dates will be set out in your quotation or invoice. Unless otherwise agreed, final design files, production-ready artwork and website handover may be withheld until the applicable invoice has been paid, subject to your statutory rights.
We may pause work on overdue accounts after reasonable notice. We will explain any additional charges and seek approval before carrying out work outside the agreed scope.
04. Design scope and revisions
Our design quotations describe the deliverables, number of concepts, included revision rounds and file formats. Unless a quotation states otherwise, bespoke design prices include up to two rounds of reasonable revisions within the agreed brief.
A revision is an adjustment to an existing direction, not an entirely new brief or replacement concept. Additional concepts, substantial changes, copywriting, photography and work requested after final approval may incur an additional charge, agreed in advance.
05. Customer materials and responsibilities
You are responsible for providing accurate text, contact details, brand assets and other requested materials in a timely manner, and for ensuring that you have permission to use anything you supply. We may rely on your instructions and may adjust delivery dates where information or approvals are delayed.
We will not knowingly use content that infringes third-party rights or is unlawful. You remain responsible for claims and factual statements in content you provide.
06. Proofs and print approval
Before print production, you will be asked to approve the final proof. Please check spelling, names, phone numbers, website addresses, QR codes, layout, quantities and the agreed specification carefully. Once you approve artwork and production has begun, changes may be impossible or involve additional costs.
Reasonable differences between screen colours and printed colours can occur because of paper, ink, finishes and device calibration. This does not remove your rights if goods are faulty or do not match the agreed description.
07. Printing and delivery
Print quantities, paper weights, sizes, finishes, binding and delivery arrangements are specified in your quotation. We arrange print production to the specifications confirmed in your quotation. Estimated production and delivery times are not guaranteed unless expressly agreed as such.
Please report damaged, missing or apparently defective goods promptly with photographs and order details so we can investigate and arrange an appropriate remedy. Your statutory rights are unaffected.
08. Website design and launch
Website proposals set out the number of pages, features, integrations, content responsibilities, testing and agreed handover arrangements. Unless specifically included, third-party subscriptions, premium plugins, domain purchases, copywriting and ongoing maintenance are separate.
We will take reasonable care in developing and testing the agreed website. You should review and approve the final version before launch. Search-engine rankings, sales, enquiries and uninterrupted operation cannot be guaranteed.
09. Hosting, domains and ongoing support
DigiMade-managed static website hosting is offered through Hosting Only (£9.99/month), Basic Care (£29.99/month) or Advanced Care (£49.99/month), with the services and limits described in the accepted plan. The hosting subscription starts at website purchase, including where design or launch work is still underway. While an eligible subscription remains active, one standard domain registration and ordinary annual renewals costing up to £20 per year are included. Customers must agree to and pay any annual domain cost above £20; aftermarket premium acquisition charges are quoted separately, and registry-premium domains may have higher renewals. Domain renewal is not included after the subscription ends. Email hosting and third-party subscriptions are separate unless explicitly agreed. See our Hosting Fair Usage Policy for file allowances, traffic reviews and exclusions. Cancellation, domain ownership and transfer arrangements are governed by the accepted hosting agreement and applicable law.
Any proposed price changes or service discontinuation will be communicated in advance in accordance with the applicable agreement and law. Website migration, backups, domain transfers and offboarding assistance are provided as agreed in the applicable plan or quotation.
10. Ownership and intellectual property
You retain rights to materials you own and provide. Subject to full payment, DigiMade will grant or transfer the rights to final approved bespoke deliverables as specified in your quotation. Preliminary concepts, unused designs, working files, reusable tools and pre-existing materials remain with their respective owners unless otherwise agreed in writing.
Third-party fonts, stock assets, software, plugins and templates remain subject to their own licences. We will identify any material third-party licence requirements relevant to your deliverables.
11. Cancellations, changes and refunds
Contact us promptly if you wish to change or cancel an order. Charges for work already performed, third-party commitments and custom print production will depend on the contract, the stage reached and your legal rights.
Consumers may have statutory cancellation rights for some distance contracts, subject to exceptions and conditions, including rules for personalised goods and services started during a cancellation period. We will not treat all deposits as automatically non-refundable or exclude rights to remedies for faulty or misdescribed services or goods.
12. Liability and complaints
We aim to resolve concerns fairly and promptly. Please email info@digimade.co.uk with your order reference and an explanation of the issue.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or statutory consumer rights. Any specific business-to-business liability limitation should be agreed in the project contract and reviewed for legal enforceability.
13. Applicable law and contact
These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections and applicable rules on court jurisdiction. Contact us if you need clarification before ordering.
